Rights forum seeks proper legal aid for those left out of NRC

District Legal Services Authority in 10 districts understaffed and under-trained, it tells Gauhati HC
A human rights organisation has approached the Gauhati High Court searching for proper legal aid for those left out of the National Register of Citizens (NRC) in Assam.
The Citizens for Justice and Peace (CJP) petitioned the court docket after its survey of 10 District Legal Services Authority (DLSA) institutions revealed they have been understaffed with under-trained para legal volunteers and poor infrastructure.
Monitored by the Supreme Court, the NRC printed on August 31, 2019 had left out 19.06 lakh of the three.3 crore candidates in Assam. A majority of those excluded are believed to be Bengal-origin Muslims, Bengali Hindus and Gorkhas.
CJP secretary Teesta Setalvad mentioned her organisation was concerned in correspondence with the National Legal Services Authority and the Assam State Legal Services Authority (ASLSA) from April-November 2020. The communication was associated to the Ministry of Home Affairs’ assertion on August 20, 2019, that legal help could be offered to the NRC-excluded individuals who want it.
The ASLSA in November 2020 responded by saying it has sufficient equipment to take care of any motion taken by the federal government with regard to the NRC and that legal camps could be organised after rejection slips are handed out to the 19.06 lakh folks explaining why they weren’t included within the record.
“But the ASLSA letter also revealed that only two taluk-level legal services authorities are functioning in a State that has 78 taluks,” the CJP mentioned.
The NGO subsequently contacted the DLSAs within the 10 districts and located they’ve 273 energetic advocates appointed for legal aid and 333 para legal volunteers whose instructional {qualifications} various from district to district.
“But no training on citizenship, immigration, NRC, Foreigners’ Act and related issues was provided in any of these 10 DLSAs. Also, apart from the Dhubri district where seven Foreigners’ Tribunal (FT) cases were handled by the counsel of the DLSA in 2019, and three in 2020, no FT cases appeared to have been handled by the counsel of the other DLSAs,” the CJP mentioned.
The High Court has issued notices to the authorities involved and glued April 5 as the following date of listening to.
