The Allahabad High Court on Friday dismissed a petition looking for instructions to the Uttar Pradesh authorities to carry out last rites, cremate or dispose the our bodies discovered close to river Ganga, saying “If there is a death in a family, is it the responsibility of the state?”
The petitioner, Pravnesh, a lawyer from Prayagraj, had pleaded with the courtroom for instructions to the State authorities and officers in Prayagraj to carry out the cremation based on spiritual rites and dispose the our bodies buried at completely different ghats in Prayagraj as early as doable.
The petition additionally sought instructions to the federal government to stop or cease the burial of our bodies close to the river.
A division bench of Chief Justice Sanjay Yadav and Justice Prakash Padia stated it was of the view that the petitioner “has not done much research work” in respect of rites and customs that are prevalent amongst numerous communities dwelling alongside the financial institution of river Ganga.
“Therefore, we are not inclined at this stage to cause any indulgence, instead to allow the petitioner to withdraw the petition with a liberty to file fresh petition after causing inquiry and research in respect of the practice of last rites in various communities which are residing along the bank of Ganga,” the courtroom stated.
During oral arguments in the case by video conferencing, when the petitioner stated it was the duty of the State to make sure the right disposal of the our bodies as per spiritual rites, the courtroom requested, “Why should the state do that? If there is a death in a family, is it the responsibility of the state?”
