The Karnataka High Court on Tuesday directed the State authorities to reply to a petition that stated B.Y. Vijayendra, son of Chief Minister B.S. Yediyurappa, and a few of his members of the family have been allowed entry into the Sri Nanjundeshwara temple at Nanjangud in Mysuru district in violation of COVID-19 lockdown norms.
A Division Bench comprising Chief Justice Abhay Shreeniwas Oka and Justice Suraj Govindaraj issued the path on a petition, filed on behalf of H.M. Venkatesh of the Nyja Horatagarara Vedike, stating the discrimination in imposing lockdown norms as VIPs have been allowed to enter temples when entry was prohibited to the general public.
Pointing out that the Chief Minister’s son was even allowed to carry out sure rituals within the temple, the vedike in its illustration to the district administration, a replica of which was submitted to the court docket, had requested how Mr. Vijayendra and his members of the family have been allowed to cross districts when the lockdown prevented residents from travelling from one district to one other, besides in instances of specified emergencies.
Meanwhile, the Bench rejected a petition in search of the restoration of the quantity spent on treating COVID-19 sufferers from political and spiritual leaders who organised occasions throughout which COVID-19 norms, together with carrying masks and sustaining social distancing, have been violated.
The Bench handed the order whereas listening to a PIL petition filed by the Letzkit Foundation on cases of violations of COVID-19 norms of carrying masks and social distancing by political events and eminent individuals.
Why no FIR?
In one other PIL petition, the Bench noticed that Commissioner of Police, Belagavi, seems to be unaware of the provisions of the Karnataka Epidemic Diseases Act, 2020, and rules that allow authorities to register First Information Reports for violations as no FIR was registered for violations dedicated throughout a political congregation attended by Home Minister Amit Shah and Chief Minister B.S. Yediyurappa in Belagavi in January.
Pointing out that the Police Commissioner has not said whether or not situations imposed within the permission granted for the congregation have been adhered to or not, the Bench requested the Commissioner to file a recent affidavit explaining why no FIR was registered, whereas observing that the State authorities seems to haven’t communicated the court docket’s order to the district authorities on requirement of registering FIR for such violations.
